Terms of Service for Users

1. Service and Tickets

1. Buyers can purchase e-tickets for events listed on the Shop. Tickets are added by the event organiser ("Organiser").
2. Melomaniac acts as a platform for ticket sales on behalf of the Organiser. The Organiser is solely responsible for the tickets, their terms, and any refunds or exchanges. Melomaniac is not the Organiser of any event.
3. To purchase tickets, Buyers select ticket type and quantity and provide required personal and payment information. Requirements may vary by event.
4. E-tickets are delivered via e-mail and made available in the Buyer's account after payment.
5. Buyers acknowledge that all rights related to tickets -including refunds, cancellations, or exchanges - are governed by the Organiser's terms. Melomaniac acts solely as a reseller/platform and is not responsible for enforcing these rights, except where required by applicable law.
6. Buyers are responsible for ensuring compliance with any applicable local laws regarding ticket use, resale, or event access.

2. Sales of Physical and Digital Products

1. The Shop may offer physical products (e.g., LPs, CDs, merchandise, apparel) and digital products (e.g., MP3s, digital albums) for sale. These products are offered and sold by the artist, band, label, promoter, record store or venue ("Seller"). Melomaniac only provides the platform for these transactions and is not the seller of any product.
2. Buyers acknowledge that all aspects of the sale - including pricing, product description, quality, availability, shipping, and delivery - are the responsibility of the Seller. Melomaniac does not guarantee the accuracy of product information or delivery times.
3. Digital products purchased through the Shop are delivered via download links or access within the platform, according to the Seller's settings. Melomaniac is not responsible for issues related to digital downloads, including file compatibility, interruptions, or technical problems outside the platform.
4. Physical products are shipped directly by the Seller. Buyers are responsible for providing correct shipping information and may be subject to additional shipping costs, customs duties, or taxes imposed by their country. Melomaniac is not responsible for shipping delays, lost shipments, or damage during transit.
5. Any disputes regarding product quality, refunds, or returns must be addressed directly with the Seller. Melomaniac may assist in communication but is not liable for the Seller's actions or omissions.

3. Buyer Responsibilities

By using the Shop, the Buyer confirms that:

1. They are at least 18 years old with full legal capacity, or a minor aged 7-17 with consent and financial support from a legal guardian, or a legal person with authority to use the Shop on behalf of the entity.
2. They provide true, complete, and accurate information.
3. They comply with these Terms, the Organiser's or Seller's terms, and all applicable laws.
4. They maintain the confidentiality of their account, user name, and password, and promptly notify Melomaniac of unauthorised use.

4. Melomaniac's Rights and Obligations

1. Melomaniac may block or suspend a Buyer if false information is provided, these Terms are violated, or legal obligations require it.
2. Melomaniac may modify or terminate the Shop, its features, or sales at any time, but will notify Buyers when possible.
3. Melomaniac processes personal data in accordance with the Privacy Policy and applicable laws, including GDPR for EU residents.

5. Intellectual Property

1. All content on the platform, including text, images, videos, audio, software, graphics, layouts, and designs ("Protected Material"), is owned by Melomaniac or the Organiser/Seller.
2. Buyers may not copy, reproduce, distribute, modify, or use Protected Material without prior written consent.
3. Content uploaded by Buyers may be used by Melomaniac in accordance with platform terms, with all rights retained by the Buyer unless otherwise agreed.
4. Trademarks, service marks, logos, and trade names displayed on the Shop are the property of their owners. Use requires written permission.

6. Personal Data and Privacy

1. Melomaniac collects, stores, and processes personal data in accordance with the GDPR for EU residents.
2. International Buyers' personal data will be processed in accordance with applicable local laws and the Privacy Policy.
3. Buyers have the right to access, correct, and request deletion of personal data as described in the Privacy Policy.

7. Payment and Fees

1. Ticket and product prices are displayed in the local currency of the event or local or chosen currency of the product.
2. Buyers are responsible for any currency conversion fees, bank fees, taxes, or other charges when paying in a different currency.
3. Payments may be made via bank transfer, credit card, or other accepted methods on the Shop.
4. Invoices are issued electronically upon request or automatically according to the payment method.
5. Melomaniac is not responsible for fluctuations in exchange rates, payment delays, or issues arising from international payment processing.
6. By completing the purchase, the Buyer confirms that payment has been made in full, in the correct currency, and understands that any additional costs related to currency conversion or banking are their responsibility.

8. Liability

1. Melomaniac is not responsible for:
   • Event content, schedule, or quality.
   • Refunds, cancellations, or compensation for tickets or products (the Organiser or Seller is responsible).
   • Delivery delays caused by incorrect Buyer information, third-party actions, or technical interruptions.
2. Nothing in these Terms limits liability for:
   • Death or personal injury caused by Melomaniac's negligence.
   • Fraud or fraudulent misrepresentation.
   • Mandatory legal obligations under Estonian, EU, or applicable local law.

9. Consumer Rights

1. Buyers who are consumers in the EU have rights under Estonian and EU law, including:
   • Right to redress for defective digital content or services, where applicable.
   • Right to contact the Consumer Disputes Committee.
2. Tickets and products may be non-refundable or non-exchangeable depending on Organiser or Seller terms. Melomaniac will clearly communicate these limitations prior to purchase.
3. Buyers outside the EU are subject to local mandatory consumer protections where applicable.

10. Force Majeure

Melomaniac is not liable for failure to perform obligations due to circumstances beyond its reasonable control, including natural disasters, strikes, wars, internet outages, or government actions.

11. Amendments to Terms

1. Melomaniac may update these Terms at any time. New Terms will be published on the website with an effective date.
2. Continued use of the Shop after publication constitutes acceptance of the new Terms.

12. Governing Law and Dispute Resolution

1. These Terms are governed by the laws of the Republic of Estonia.
2. Disputes with Buyers may be resolved in the Harju County Court, Estonia.
3. Buyers who are consumers may also contact the Consumer Disputes Committee or use online dispute resolution platforms, as applicable.
4. International Buyers acknowledge that local mandatory laws may provide additional rights that cannot be waived.
